The Federal Trade Commission (FTC) announced new required standards for "safe harbor" status regarding the Initial Privacy Notice effective January 1, 2011. WATDASI's Initial Privacy Notice has been discontinued. Dealers may continue to use the form after January 1, 2011 but they lose safe-harbor protections. For dealers that offer finance or lease services to their customers WATDA recommends you use the New Model Privacy Notice.
WATDA also recommends use of the stock form "Acknowledgement of Receipt of Documents" , WATDA form #21. By collecting the customers' signatures in one place on the Acknowledgement dealers adequately document the transaction while avoiding keeping copies of the Privacy Notice and the Risk Based Pricing Notice or Exception Notice in the deal jacket.
