The Federal Trade Commission (FTC) announced new required standards for "safe harbor" status regarding the Initial Privacy Notice effective January 1, 2011. WATDASI's Initial Privacy Notice has been discontinued. Dealers may continue to use the form after January 1, 2011 but they lose safe-harbor protections. For dealers that offer finance or lease services to their customers WATDA recommends you use the New Model Privacy Notice.
Dealers can use the form filler on the FTC's website but it doesn't provide the required language for the variable content fields. The New Model Privacy Notice form has very strict print and construction guidelines regarding font, print placement, and variable content. The changes required in the new Initial Privacy Notice are complex.

WATDA recommends dealers use a custom Privacy Notice with a stock Acknowledgement of Receipt of Documents (Acknowledgement), WATDA form #21. By collecting the customers' signatures in one place on the Acknowledgement dealers adequately document the transaction while avoiding keeping copies of the Privacy Notice and the Risk Based Pricing Notice or Exception Notice in the deal jacket.
