Motor Vehicle Consignment Agreement

Under a consignment sale agreement, a dealership does not have ownership of the vehicle but is authorized to sell it for the individual who does have ownership. Only licensed dealers may offer vehicles for sale on consignment. Consignment sales are prohibited between dealers and between wholesalers and dealers. Dealers offering a consignment vehicle for sale must execute and retain a written consignment agreement between the owner of the vehicle and the dealer. The dealer must also have a written consignment agreement and odometer statement for each vehicle offered for sale and not owned by the dealer. In addition, dealers must file a Security Interest for consigned vehicles not owned for personal, family or household uses. Selling a consigned vehicle is otherwise the same as selling any used vehicle. An inspection must be conducted and a Wisconsin Buyer's Guide must be displayed. A Consignment Odometer Disclosure and Consignor's Representations Statement should be signed by the consignor at the same time the Motor Vehicle Consignment Agreement is signed.
